Mut zum Tigersprung – Just do it!

Im Rahmen eines Entschließungsantrags der Fraktionen von SPD und Bündnis 90/Die Grünen fand am 28.01.2016 eine Anhörung des Ausschusses für Bundes- und Europaangelegenheiten, Medien und Regionalentwicklung des Niedersächsischen Landtages statt. Hier meine Stellungnahme.

„Postcolonial Piracy“ online

Postcolonial_PiracyThe anthology Postcolonial Piracy. Media distribution and cultural production in the global south, edited by Lars Eckstein and Anja Schwarz from Potsdam University, is out. It was published by Bloomsbury in late 2014 whom Lars and Anja convinced to do so under a CC licence. The book says BY-NC-SA while the university website says BY-NC-ND and the Bloomsbury website doesn’t say anything at all.  Bloomsbury presents the book in „PDF page image format“ as „Bloomsbury Open Access“, telling the reader: „The pages are provided here to facilitate browsing. If intending to read in full, you may prefer to download the original PDF,“ but not providing an opportunity to download. Anyway, it is available for download as postprint at the University Potsdam.

The collection comes out of a conference under the same title in December 2011 in Berlin. It includes my contribution „On the Benefits of Piracy“, pre-published under the title „A Proposal for Legalizing Small-Scale Physical Copyright Piracy Book Publishing, Video Films and Music in Developing Countries“.

„Alternative distribution models in the digital environment”, Riga, 23 April

The seminar „Alternative distribution models of works protected by copyright in the digital environment” will take place on 23 April 2013 from 9:30 – 14:00 at Riga International School of Economics and Business Administration (RISEBA), Architecture and Media Centre “H2O 6” (Riga, Ūdens iela 6). It is oranised by the Ministry of Culture of Latvia in cooperation with the British Council in the context of Creative Action Week “Create!” (22 to 28 April).

The seminar-discussion will be devoted to tendencies of copyright in the current digital environment. The local and foreign experts will discuss the alternative distribution models of music and e-books online providing their easy accessibility, on one hand, and fair remuneration to the authors, on the other hand. The topics presented by the experts will include: possibility to introduce so-called culture flat-rate for the use of culture products; current tendencies of management of online music rights in Europe, the role of the collective management organisations therein and others.

Participants include Žaneta Jaunzeme-Grende, Minister of Culture; Magda Papēde, doctoral candidate of the University of Freiburg (Germany); Guna Zučika, manager of the band “Brainstorm”; Uldis Zariņš, head of Strategic development unit of the National Library of Latvia; Ilona Tomsone and Rihards Gulbis, Legal Advisors on copyright, Ministry of Culture and myself.

Sharing Licence Library

This is a collection of materials on the proposals to legalize file-sharing in exchange for a flat-rate remuneration. These proposals are as old as P2P file-sharing itself. They have been advanced by law scholars, people from the music industry, consumer and Internet user organisations, collecting societies and political parties. They have come in the form of feasibility studies, passionate manifestos, scholarly and popular articles, law proposals and (near) pilot projects. And they have come under names such as alternative compensation system, content or culture flat-rate, licence globale, artistic freedom voucher, noncommercial use levy and sharing licence. If you have materials (text, audio, video) that should be in this collection, please mail me. A Proposal for Legalizing Small-Scale Physical Copyright Piracy Book Publishing, Video Films and Music in Developing Countries

The paper looks at the formative phase of media systems particularly in developing nations. It finds that copyright piracy in those situations serves a purpose not only in providing access to knowledge and creative works to audiences who would otherwise be excluded but also as the original accumulation of media infrastructures, know-how and capital that over time leads to the establishment of original forms of creative expression and legal media industries.

Looking at the examples of the publishing of books by foreign authors in 19th century USA, the emergence of the video film industry in Nigeria and briefly at the popular dance music in northern Brazil it shows the beneficial effects of piracy. From a public policy point of view, the paper then considers the benefits of copyright piracy and its harms, the most severe ones of which are caused by its illegality. In order to balance benefits and harms, it concludes by proposing to legalize small-scale physical copyright piracy in developing nations.

After a grandiose start in 2012, the music-based digital culture conference and festival Digitalia goes into its second year. It is part of an ambitious endeavor that includes research, education, publications, numerous events and the establishment of a Centre for Digital Music and Culture. Digitalia is organised by the social network Audiosfera and the research group of the same name, hosted at the Institute of Humanities, Arts and Sciences Professor Milton Santos at the Federal University of Bahia under the direction of Messias Bandeira. I’m honored to have been invited as one of the curators of Digitalia.

Next year’s themes are: Music and digital culture; economy of online music; copyrights, music and digital culture; music, digital culture and innovation; transversalities. For more details see (in Portuguese):

Konferenz: Vergüten statt verfolgen

Raetsel_Urheberrecht_Horia_Varlan_flickr_CC_BY_20_320x240Am 31. August und 1. September findet in den Berliner Uferstudios (Badstraße 41, 13357 Berlin-Wedding) die Grüne Urheberrechtsfachtagung „Vergüten statt verfolgen“ statt. Das ausführliche Programm gibt es hier (PDF).

Zu den Vortragenden gehören Wolfgang Blau, Jeanette Hofmann, Markus Beckedahl und Olaf Zimmermann. Am Samstag, 1. September, 14:00 – 16:00 Uhr, werde ich, moderiert von Tabea Rößner, mit Gisela Schmalz, Helga Trüpel, Gerald Spindler und Tim Renner über „Alternative Vergütungsansätze und zeitgemäße Finanzierungsmodelle“ sprechen, m.a.W. über die Tauschlizenz.

Die Veranstaltung wird vom Bundesvorstand von BÜNDNIS 90/DIE GRÜNEN zusammen mit den Bundesarbeitsgemeinschaften Kultur, Medien und Netzpolitik, Demokratie und Recht, Bildung und Wissenschaft sowie Hochschule und Technik organisiert.

„Auch in dieser Woche wurde die Debatte um’s Urheberrecht erbittert weitergeführt. Etliche Autoren und Künstler unterzeichneten einen Offenen Brief und wandten sich darin gegen Gier und Diebstahl – was in ihren Augen offenbar die einzige drohende Alternative zum jetzigen Urheberrechtsystems sei.

Dass dem durchaus nicht so ist, weiß Volker Grassmuck. Der Mediensoziologe hat sich eingehend mit dem Modell “Kulturflatrate” auseinandergesetzt (hier könnt ihr sein umfangreiches Vorschlag-Paper herunterladen) und plädiert dafür, eine solche schleunigst in einem Pilotprojekt auszuprobieren. Wie weit Deutschland in dieser Sache ist und ob er eine realistische Chance für eine Kulturflatrateregelung hierzulande sieht, darüber spricht Jan dann nachher mit ihm in der Sendung.“
